Terms of Service

These Terms govern your access to and use of Tcom Mail and all related products, websites and services.

Last updated: October 10, 2026

Please read these Terms of Service (the “Terms”) carefully. They form a binding agreement between you (“you”, “Customer” or “User”) and Tcom Mail (“Tcom”, “we”, “us” or “our”) and apply to your use of our websites, including tcom.app, africomail.com and mailo, our dashboards, APIs, mobile and installable applications, and all associated email, messaging, hosting and marketing services (together, the “Services”).

By creating an account, connecting an existing mailbox, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, you must not use the Services.

1. Accounts and eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. You are responsible for all activity that occurs under your account and for keeping your login credentials confidential.

You agree to provide accurate, current and complete information during registration — whether you create a new Tcom mailbox or connect an existing third-party mailbox — and to keep that information up to date. We may suspend or terminate accounts that contain false, outdated or misleading information.

  • You are responsible for maintaining the security of your account and any connected mailbox credentials.
  • You must notify us immediately at [email protected] of any unauthorised use or security breach.
  • You may not share, sell, or transfer your account to any third party without our written consent.

2. The Services

Tcom provides email marketing and transactional sending, SMS and multi-channel messaging, contact management, automation, private email hosting, domain tools and related features. Some features are offered on a free tier and others require a paid subscription or usage-based charges.

We continually improve the Services and may add, modify or remove features. Where a change materially reduces core functionality of a paid plan, we will make reasonable efforts to notify you in advance.

3. Acceptable use and anti-spam

Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. You are solely responsible for the content you send and for obtaining all required permissions and consents from your recipients.

You agree to send only to recipients who have given you permission to contact them, to honour unsubscribe and opt-out requests promptly, and to comply with all applicable laws, including anti-spam and electronic communications laws such as the GDPR, CAN-SPAM Act, CASL and comparable regulations in your recipients' jurisdictions.

  • No unsolicited bulk email or purchased, rented or scraped contact lists.
  • No deceptive subject lines, headers, or sender information.
  • No distribution of malware, phishing, or fraudulent content.
  • We may scan, throttle, suspend or block sending that threatens deliverability or violates this section.

4. Plans, fees and billing

Paid plans are billed in advance on a recurring basis (monthly or annually) and/or based on usage such as the number of emails, messages or contacts. By subscribing, you authorise us or our payment processors to charge your chosen payment method for all applicable fees and taxes.

Unless stated otherwise, subscriptions renew automatically at the end of each billing cycle. You may cancel at any time; cancellation takes effect at the end of the current paid period. Refunds, where available, are governed by our Refund Policy.

We may change our prices. For recurring subscriptions, price changes apply from your next renewal after we provide reasonable notice.

5. Connected third-party mailboxes

If you connect an existing external mailbox (for example Gmail, Outlook, Yahoo or a custom-domain mailbox), you authorise Tcom to access that mailbox using the credentials or app password you provide, solely to deliver the Services you request — such as sending, syncing and displaying your messages.

We store connection credentials in encrypted form. Your email continues to be governed by your provider's own terms, and you remain responsible for complying with them. You may disconnect a mailbox at any time from your dashboard.

6. Your content and data

You retain all rights to the content, contact data and materials you upload, send or store through the Services (“Your Content”). You grant Tcom a limited, worldwide, non-exclusive licence to host, process and transmit Your Content only as necessary to provide and improve the Services.

You represent that you have all rights and consents necessary for Your Content and for contacting your recipients. Our processing of personal data on your behalf is described in our Privacy Policy.

7. Intellectual property

The Services, including all software, designs, text, graphics and trademarks, are owned by Tcom or our licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, nothing in these Terms transfers any ownership to you.

You may not copy, modify, reverse engineer, resell or create derivative works from the Services except as permitted by law or with our prior written consent.

8. Suspension and termination

We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if your use poses a security, legal or deliverability risk, or if required by law. You may terminate your account at any time.

Upon termination, your right to use the Services ends. We may delete Your Content after a reasonable retention period, except where we are required to retain it by law. Sections intended to survive termination — including payment obligations, disclaimers, and limitations of liability — will continue to apply.

9. Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, Tcom disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular deliverability, open or response rate will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, Tcom and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to your use of the Services.

Our total aggregate liability for any claim relating to the Services will not exceed the amounts you paid to Tcom for the Services in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Tcom from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, your violation of these Terms, or your infringement of any third-party rights or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws applicable at Tcom's principal place of business, without regard to conflict-of-law rules. You agree to resolve disputes first by contacting us in good faith. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of that location, unless mandatory local law provides otherwise.
